Terms and Conditions of Sale

1. Purpose

These General Terms and Conditions of Sale (GTC) govern the contractual relationship between MV3D, hereinafter referred to as "the Seller," and any natural or legal person wishing to make a purchase via the mv3d.fr website, hereinafter referred to as "the Buyer."

2. Products

MV3D offers products handcrafted using 3D printing. Products can be:

  • Standard: products available in stock, as presented on the website.
  • Customized: products made to measure according to specifications provided by the Buyer (dimensions, color, shape, text, supplied file, etc.).

Some products offered on the site are entirely designed by MV3D, from the design plan to the final product. These original creations are the result of continuous development work. In this process of permanent improvement, MV3D welcomes any feedback or comments from its customers. Every opinion is an opportunity to progress and offer ever higher quality products.

3. Price

Prices are indicated in euros, all taxes included (TTC). The Seller reserves the right to modify its prices at any time, it being understood that the price listed in the catalog on the day of the order will be the only one applicable to the Buyer.

4. Order

The Buyer places their order online from the website. The sale will be considered final after the order confirmation is sent by e-mail and payment is collected. For customized orders, the Buyer is invited to carefully check the specifications provided before validation, as these commit to manufacturing.

5. Payment

Payment for purchases is made using the payment methods offered on the website. Payment is due immediately upon order.

6. Manufacturing and Deadlines

MV3D products are manufactured to order using 3D printing. Manufacturing and delivery times are given as an indication and may vary depending on the complexity of the part and the production load. The Buyer will be informed in case of exceptional delays.

7. Delivery

Products are delivered to the address indicated by the Buyer when placing the order. It is the Buyer's responsibility to check the accuracy of the delivery information provided (surname, first name, full address) before validating their order.

Any delay, delivery failure, or additional costs resulting from an error or omission in the information provided by the Buyer (incomplete or incorrect address, incorrect surname or first name, etc.) cannot give rise to any interest, compensation, or damages of any kind whatsoever at the expense of the Seller. Any re-shipping costs will be borne exclusively by the Buyer.

Similarly, any reasonable delay attributable to the carrier cannot give rise to the Buyer being awarded damages.

8. Right of Withdrawal

Standard Products: In accordance with Article L.221-18 of the Consumer Code, the Buyer has a period of 14 days from receipt of the product to exercise their right of withdrawal, without having to give reasons or pay penalties. The product must be returned in perfect condition.

In accordance with Article L.221-23 of the Consumer Code, return costs are in all circumstances borne exclusively by the Buyer, regardless of the reason for withdrawal. The Buyer is informed of this condition prior to any order by this mention.

Customized Products: In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalized. Any validated and manufactured customized order cannot be canceled or refunded, except in the case of a proven lack of conformity.

9. Technical Characteristics and Visual Appearance

MV3D products are manufactured by 3D printing using material deposition (FDM/FFF). This manufacturing process involves visual and technical characteristics specific to the technology, which do not constitute manufacturing defects in any way:

  • Layer lines: the successive deposition lines of the print layers are visible on the surface of the parts. This is a characteristic inherent to the FDM process, accepted and known in the field of 3D printing.
  • Slight surface variations: small irregularities or marks related to the printing process may be present and are considered normal.
  • Color variations: slight shade variations may exist between two orders of the same product depending on the batch of material used.

The Buyer acknowledges having been informed of these characteristics prior to placing their order and cannot invoke these elements as a reason for return, cancellation, or refund.

10. Guarantees and Defects

All products benefit from the legal guarantee of conformity (Articles L.217-4 et seq. of the Consumer Code). In case of a defect found upon receipt, the Buyer must contact the Seller within 48 hours with supporting photos.

Considered defects are: broken part, dimensions not conforming to validated specifications, or any structural defect rendering the product unusable. Visual characteristics inherent to 3D printing described in point 9 are not considered defects.

In the event of a proven defect, the Seller undertakes, as a priority, to remake and resend the product at its own expense as soon as possible.

In the event that remaking or resending is not possible (material shortage, production stop, or any other reason making the solution impossible or disproportionate for the Seller), the latter will then offer the Buyer, at their choice:

  • A credit note of an equivalent amount, usable on a future order;
  • A full refund for the defective product.

11. Personal Data

The information collected is necessary for processing your order. In accordance with the GDPR, you have the right to access, rectify, and delete your data.

12. Mediation and Dispute Resolution

In accordance with Articles L.616-1 and R.616-1 of the Consumer Code, MV3D offers a consumer mediation scheme. In the event of a dispute not resolved amicably, the Buyer may freely use the following mediator:

  • Consumer Mediator: CM2C (Centre de Médiation de la Consommation de Conciliateurs de Justice)
  • Website: www.cm2c.net
  • Email: cm2c@cm2c.net

The Buyer may also use the European online dispute resolution (ODR) platform: https://ec.europa.eu/consumers/odr

13. Disputes

In the event of a dispute not resolved through mediation, French courts will have exclusive jurisdiction.
